What Does it Mean if I Have a Personal Injury Case?
Under Illinois law, if you are injured because of the careless actions of another person, you may have a claim for negligence, and you may be legally entitled to pursue financial compensation for your injuries, known as “damages”. This law is based on the personal responsibility each of us has (known as a duty of care) to act in a reasonably safe or non-negligent manner toward others. For example, when we operate a motor vehicle, we have a duty to obey the traffic laws, and to operate our vehicle in a reasonable and safe manner to avoid an accident that could injure someone. When a person violates their legal duty to act in a reasonable and safe manner, and injures someone, the responsible person (and their insurance company) must pay damages for the injuries they cause.
What Types of Personal Injury Cases Does Our Injury Law Firm Handle?
Claims for personal injuries may arise from car accidents, dog bites, slip, trip and falls or premises liability, defective products, nursing home negligence and many other types of injury-producing accidents. The attorneys at John J. Malm and Associates have decades of wide-ranging experience in personal injury litigation, and we handle many types of injury cases:
- Car accidents: injuries from accidents involving cars, automobiles, rideshare companies, buses, bicycles, pedestrians, trucks, uninsured motorists, and all forms of driver negligence.
- Dog bites and animal attacks: injuries from unprovoked animal attacks, sometimes involving dangerous breeds such as Rottweilers and pit bulls; can be based on strict liability (Illinois Animal Control Act, 510 ILCS 5/1 et seq.) or negligence (harboring a dangerous animal).
- Uninsured motorist claims: accidents resulting in injuries because of the negligence of uninsured drivers of cars, motorcycles, trucks, and other vehicles. Victims who may file a claim include pedestrians, bicyclists and persons injured in hit and run accidents.
- Motorcycle Accidents: injuries from accidents involving motorcycles and other vehicles, such as trucks, cars, or buses, which often result in death to the motorcycle rider.
- Bicycle accidents: injuries suffered by bicycle riders in accidents involving cars, trucks, and other vehicles, all of which can be serious and sometimes fatal for the bicyclist.
- Truck accidents: injuries from accidents involving trucks of all types, including commercial semi-trucks, delivery vans, and 18 wheelers. Often serious injuries occur due to the enormous size and weight of these vehicles.
- Pedestrian accidents: injuries from accidents that occur when a pedestrian is struck by a vehicle whose driver is at fault for causing the accident, often in a crosswalk or at a place where pedestrians would otherwise be safe.
- Hit and run accidents: injuries suffered someone in a car accident in which a driver has fled the scene of a collision and cannot be identified; a hit and run crash often involves pedestrians, bicycles and other vehicles; hit and run claims may be a covered loss when presented against the victim’s uninsured motorist coverage, after a written demand for arbitration under the terms of the policy, even if injuries were sustained to a pedestrian or bicyclist.
- Rideshare accidents and taxicab accidents: injuries from accidents involving taxicabs, Uber and Lyft vehicles. Injuries may be to a passenger or to a person in another vehicle.
- Boating accidents: caused by negligence, inattention, inexperience, alcohol use, or machinery failure in the operation of boats, personal watercraft (PWC) and small watercraft, which often result in serious injury or death.
- ATV accidents: serious injuries resulting from the operation of all-terrain vehicles (ATVs or four wheelers), motorcycles, or other off-road or recreational vehicles; often cause TBI, closed head injuries, spinal cord injuries, traumatic amputation and wrongful death.
- Train, mass transit and railroad accidents: injuries from accidents involving passenger trains and freight trains, sometimes at a defective railroad crossing, often resulting in death.
- Work injuries and Workers’ Compensation Claims: these injury claims arise when a worker is injured or becomes ill due to their job; may include a claim for a portion of the wages and medical costs of the worker. Work accidents resulting in an injury to an employee suffered while engaged in work on behalf of an employer are compensable by showing that the injury occurred on the job and while performing work. Negligence need not be proved. Claims fall under the Illinois Workers’ Compensation act.
- Medical malpractice: injuries or wrongful death caused by medical negligence; medical malpractice cases must be proved by showing a violation of the applicable standard of care, for surgical errors, birth injuries, failure to diagnose, failure to treat, or administrative or medication errors.
- Nursing home negligence: claims for injuries suffered by a nursing home resident, such as falls, broken bones, bedsores, dehydration, malnutrition, medication errors, and elopement or wandering (failure to supervise) due to negligent care or a violation of the Illinois Nursing Home Care Act.
- Premises liability: injuries from slip and fall accidents that result from broken stairs, unsafe walkways, spilled liquids and slippery surfaces, icy conditions due to unnatural accumulations of snow and ice, broken handrails, insufficient lighting, or negligent property maintenance by the owner or occupier of land or property. Claims may involve a landlord ‘s property, or a homeowner’s association, as well as a commercial/retail property.
- Product liability: injuries suffered by use of a dangerous product; liability is imposed against manufacturers for accidents and injuries that result from unsafe products, defective products, or products which fail to warn of a dangerous condition.
- Child injuries: injuries suffered by children in accidents in which negligence has occurred; child injuries require court approval and sometimes a separate guardianship proceeding.
- Fatalities (Wrongful Death): fatal accidents; accidents resulting in injury and death due to negligence for which a lawsuit is brought on behalf of loved ones – the family and spouse – of the deceased, for the love, support and companionship that has been lost. Cases for wrongful death may be brought by an executor (in the case of a will), administrator (in the case that no will is left) or the special administrator (a person appointed solely to bring a wrongful death claim for the survivors), all of whom must first be appointed by the court.
- Catastrophic injuries: Serious injuries with life-altering consequences, often resulting in disability. In some cases, such injuries result in the need for in-home medical assistance or a life care plan.
- Closed Head Injury: a type of traumatic brain injury in which the skull and dura mater remain intact. A serious injury that often results in life-long consequences, including physical, psychological and cognitive impairment.
- Traumatic Brain Injury (TBI): A traumatic brain injury (intracranial injury) to the brain that is caused by an external force. TBI may be classified based on severity, ranging from mild to severe.
- Amputation: injuries such as the loss of a finger or limb due to a serious accident, sometimes referred to as traumatic amputation.
- Burns: serious burn injuries, which often result in scars and disfigurement, sustained because of negligence. Can occur from exposure to a chemicals, a heat source or even electrical current.
- Airbag injuries: serious injuries, such as the recent Takata airbag recall, which result in serious injuries after an airbag is unsafely deployed or fails to deploy. Defects in airbags sometimes result in projectile injuries, while other times injuries are sustained because of an airbag’s failure to deploy after a heavy impact crash, despite a triggering event.
- Spinal cord injuries: serious injuries to the spinal cord that may cause loss of muscle function, sensation, or autonomic function in the parts of the body served by the spinal cord below the level of the injury; may be caused by trauma or injury to the spine from a car accident, a sports injury, or other cause.

- Sports injuries: injuries suffered to a participant or even a spectator resulting from a violation of an applicable legal standard, such as negligence or reckless (willful wanton) conduct, considered to be outside the rules applicable in the conduct of a given sport; sports related injuries are most common in youth sports.
- Shoulder injuries: injuries to the glenohumeral joint, such as the labrum or rotator cuff, sustained because of trauma, either due to a fall, a work-related injury, or a car accident.
- Hip fractures: a serious fracture to the upper part of the femur, near the femoral neck or the femoral head to the hip, which often requires surgery with hardware, often because of a slip, trip and fall, nursing home accident, car accident, or work-related accident.
Our Skilled Injury Lawyers Will Help You Obtain the Maximum Compensation (“Damages”) for Your Personal Injury Claim.
We understand that right now you are bearing the burden of someone else’s careless mistake. When you suffer an injury because of an accident, your health, and indeed your normal life, has been taken from you, at least in part. The negligent party has left you to bear the consequences of their careless actions. Even if your injuries are not permanent, you may be forced to pay medical bills, attend physical therapy appointments and follow-ups, and work through your pain to physically heal. Going back to work may not even be possible right now.
The personal injury attorneys at John J. Malm Associates know that taking proper legal action and seeking payment for your damages is the only way to help compensate you. Our goal is to place the burden of your loss onto the responsible person, where it legally belongs (i.e., to make the insurance company take responsibility by paying for the harm their driver or client has caused). This is the sole remedy our civil justice system affords. We fight to recover money for you, known as “damages”.
Our Promise to You.
