Jury Awards Mother $1.4 Million in Decapitated Baby Case

LOUISVILLE, Ky. — A jury has awarded a local mother nearly $1.4 million in damages after her premature son was decapitated during delivery at Norton Suburban Hospital.
“I think this is a vindication for Micheatrea and all that she went through,” said Mark Mathys, one of Donelson’s attorneys.
In 2006, Donelson went into labor after just 21 weeks of pregnancy, and her child was decapitated during the premature delivery.
She sued two doctors and Norton Suburban Hospital.
“We think that justice was served here today. The jury found in favor of Micheatrea and found that these doctors did not deliver the standard of care that’s required of doctors in this community,” said Larry Jones, another of Donelson’s attorneys.
“One point four million dollars is a significant amount of money, which shows the harm that she had suffered,” Mathys said.

John J. Malm was one of the lawyers retained to represent a young woman who tragically witnessed the decapitation of her baby during premature delivery. The jury found for the woman and against the doctors, awarding the client $1,362,000 in damages for the severe emotional injuries she suffered. Co-counsel, Mark Mathys, tried the medical malpractice case before a Louisville, Kentucky jury.
